Port Townsend Washington can and SHOULD pass an environmental bill of rights. Port Townsend Washington Environmental Bill of Rights ~ the TIME has Come. Time for the RESIDENTS of Port Townsend to STEP up and MAKE Law that STANDS up for their Rights to Clean Air and Clean Water per the Clean Air Act, and the Clean Water Act.


Port Townsend Washington Residents have a RIGHT to Clean Air, Water and Soil and to act responsible on what is leaving the County, such as TOXIC SLUDGE.

"CITY HALL — The City Council approved a unique law this week that enshrined the rights of the environment and residents’ rights to clean air and water.

The ordinance, known as the Sustainability Bill of Rights, asserts that corporations and their leadership do not have special privileges or powers under the law that supersede the community’s rights.
It also requires that the Office of Sustainability and the Environment prepare a report every two years documenting progress on the Sustainable City Plan, an effort begun in the mid-1990s to create benchmarks and goals to make Santa Monica more environmentally friendly, and that City Hall hold a public hearing.
Finally, and perhaps most controversially, some believe that the law gives residents the ability to sue a polluter themselves when one of those rights are violated, without waiting for City Hall or other agencies to get the ball rolling.
The ordinance was, in Councilmember Kevin McKeown’s words, a fundamental power shift away from business interests and toward the community that has not yet happened in the environmental movement.
“Unrestrained capitalism has extracted the good out of our environment in many, many cases. Here, for the first time, we as 
a city are taking a stand and saying we’re not going to let that happen anymore,” McKeown said.

The Sustainability Bill of Rights emerged from the Task Force on the Environment — consisting of a group of residents — after the 2010 U.S. Supreme Court decision Citizens United vs. Federal Election Commission, which further cemented the rights of corporations as individuals in American law. The court’s decision opened the doors to unlimited campaign spending on behalf of companies.
The law was also a reaction to the spread of fracking, a process of extracting fossil fuels from the ground that many environmentalists say is extremely damaging to the environment, poisoning groundwater and even causing earthquakes.
The City Council approved a resolution in January 2012 backing the concept of the Sustainability Bill of Rights, but the resolution had no teeth. Those in support of the law passed Tuesday feel the City Council’s vote changed that.
“The fact that it establishes individual environmental rights is very important,” said Mark Gold, former president of nonprofit Heal the Bay and associate director of the UCLA Institute of the Environment and Sustainability.
Gold has spent much of his career fighting to save the environment from the negative impacts of human habitation on the Santa Monica Bay and other water ecosystems.
His primary tool was the Clean Water Act, a 1972 federal law that regulates quality standards for surface water, but the law lost effectiveness and involved arcane measurements that were difficult for members of the public to understand.
This ordinance finds strength in its return to basic environmental roots, Gold said.
Supporters of the Sustainability Bill of Rights believe that the law gives them the ability to sue polluters in court if City Hall does not do so. That could include what some call  Santa Monica’s “groundwater wars,” with over a decade spent in court to get companies to clean up dangerous chemicals that had leached into the groundwater through buried gasoline storage tanks.
“That legal standing did not exist before,” said Cris Gutierrez, a member of the Task Force on the Environment.
It was carefully-crafted to prevent abuse, and cannot be used to protect every street tree or stop every development in the city, Gold said.
“The ability of an individual to sue the city because they don’t like a development approval, that’s not in there,” Gold said.
Whether residents will be able to file any kind of lawsuit may be up to the courts to decide.
Jeff Caufield, an environmental attorney with the Los Angeles firm Caufield & James, thought there might be some conflict if a resident filed a private suit or acted as “a private attorney general.”
“It will likely need to be litigated and a decision made by a court on this particular ordinance and language,” Caufield said.
In the meantime, Gold hopes that the ordinance will keep the environment front and center for policy makers, and be a model for other cities who want to take a stand on the environment.
“There is a precedent-setting nature to this that the city is very aware of,” Gold said."
This is amazing, a HUGE precedence. Communities EVERYWHERE should take this example and stand up for your RIGHT to Clean Air, Clean Water, and Clean Soil.

Sustainability Bill of Rights; What other areas are doing that Port Townsend Washington Residents Could Do. "corporations and their leadership do not have special privileges or powers under the law that supersede the community’s rights"


If Port Townsend City can enact a LAW to not use Plastic Bags, then surely the City of Port Townsend would care more about ammonia and other toxins in the air and water. And therefore Enact Laws in order to Protect the Citizens of Port Townsend. And NOT simply let the Port Townsend Paper Mill run amok and possibly poison Port Townsend Washington Residents, Water, Soil, Sea Life, Plants and Animals.

Here is a GREAT Example of what  Port Townsend Washington Residents can do to FIGHT BACK. This is not about hippies, environmentalists, loggers, or jobs, this is a matter of are  Port Townsend Washington Residents being poisoned or not. If so then no job or profit of any kind is worth it.

I am a online marketing expert. I make a living online. However I have also owned my own real estate brokerage for over 12 years, and I say there is NO WAY that shutting down the Mill or making the mill obey the law, will affect the economy here. I say the ECONOMY will be stronger, will be more based in Organic Farms, Artists, Writers,  higher learning and many others ways in which will be a truly "Clean Community".

It is a MYTH that Port Townsend Washington will collapse if the Port Townsend Washington Residents FORCE the Port Townsend Paper Mill to obey the law and YOUR Constitutional Rights. 

Based on the Clean Water Act, a 1972, the City of Port Townsend, Jefferson County, could actually enact law to STOP the pollution of the Port Townsend Bay, Port Townsend Air, Water and Soil, BY LAW and constitutional rights.

The Port Townsend Paper Mill is Not about a "Conversation" nor about "Opinions"; it is about Fact, Law and Constitutional Rights.

If one is a Port Townsend Council Member or running for council. It is not about having a conversation on some issues, it is simply about will you obey the law and our constitutional rights Period?

This is not about Opinion, nor about some "conversation".  Nor is it about being civil or not being civil. It is SIMPLY, Lawfully, and Constitutionally about accountability, transparency, and upholding the law, the bill of rights and the constitution.

The Port Townsend Paper Mill is breaking the law. The Port Townsend Paper Mill is violating the clean air act. And it is the duty of a councilman elect or a council member to defend the rights of the citizens period. And that is not based on Opinion nor Conversation to convince anyone what our rights are.  They are clear fact.

The Port Townsend Paper Mill is violating your constitutional right to clean air, clean water, and clean soil.

The Port Townsend Paper Mill is violating the Bill of Rights.

The Port Townsend Paper Mill has gotten massive grants, hand outs, free water, tax credits and all to provide those 300 jobs, which is 1% of the population of Jefferson County. However, if those folks with those jobs got all the grants and hand outs the mill has gotten or even SOLD the water the mill uses daily, they would have way more money then they do now and without being exposed to massive KNOWN toxins or even having to go to work everyday.

We do not need to necessarily REPLACE the Port Townsend Paper Mill. There will be plenty of industry here, and no need for large greedy corporation who get hand outs, create toxin air water and soil and violation our constitutional rights.

The Port Townsend Paper Mill is NOT using modern technology to clean their emissions and the City of Port Townsend and Jefferson County are NOT making them.  They will not spend the money unless they are forced to.

The City of Port Townsend, Jefferson County, the DOE and Jefferson County Healthcare coddle, enable and pave the way for the Port Townsend Paper Mill to break the law and violate the constitution. They disguise it, cover it up and flat out lie about it's existence. And all to enrich a greedy corporation and it's insatiable shareholders.


This is NOT about having a constructive or even a civil conversation. It is about being willing to actually enforce law and constitutional rights period.

The Port Townsend Paper Mill is spewing known Toxins

Jefferson County Health and local Doctors know this, as many have left town due to massive health risks and concerns. It is time for accountability and to STOP violation the rights of citizens and tourists breathing, not just smelly air, but ammonia and other toxins and fine particles that cause damage to lungs and other human organs.

This on top of the massive water issue and total lack of respect for soil, fisheries, marine life, emergency drought conditions and air quality.

The Port Townsend Paper Mill affects the ozone layer, and emissions really do affect climate change. This is pure fact and science. So why not stand up to them and get them out of your community.

Jobs is NO Excuse. TOXIC Jobs that harm others NEED to NOT be here or anywhere. There are thousands if not millions of non-Toxic ways to create, generate and stimulate economy / money.

Emission standards are legal requirements governing air pollutants released into the atmosphere. Emission standards set quantitative limits on the permissible amount of specific air pollutants that may be released from specific sources over specific time frames. They are generally designed to achieve air quality standards and to protect human health.

However, it takes local politicians, authorities, governing bodies to actually have the balls 
and the backbone to enforce those laws in order for them to actually protect the citizens 
in any given area.

It is about Obeying the Law and Upholding our Constitutional Rights and in this day and age also about taking Climate Change SERIOUS.

Stephanie Ogle and the Washington Department of Ecology is not really a People BEFORE Profit sort of group. Yet they are paid by public dollars. The PT Mill self monitoring is NOT Good Enough.

Stephanie Ogle of the Washington  Department of Ecology is assigned to regulate the Port Townsend Paper Mill and claims to follow up on all odor complaints. However, all this seems to be is to contact the mill and see if everything was normal and okey dokey on that day. The Mill says Ya all is well and well that is that. So it would seem that the Washington Department of Ecology is really out to protect the mill and not the water, air, soil, and people in Washington.

Kind of like asking a criminal if they committed the crime, of course they say NOPE sure didn't.

Stephanie Ogle and the Washington  Department of Ecology is not really a People BEFORE Profit sort of group. Yet they are paid by public dollars. 


The Bottom Line is the mill is, in my understanding of the laws, breaking the clean air, clean water and clean soil laws. They are harassing us constantly and ruining our legal right to quiet enjoyment of property. The Port Townsend Paper Mill, I allege, is breaking the Clean Air Act, and yes are committing crimes on the residents of Port Townsend.

The Washington Department of Ecology allegedly logs odor complaints, SO WHAT. They are supposed to protect the water, soil, air and people of Washington. Instead they protect the profits of the Crown Paper Group, not even based out of Washington.

Complaining about Odor is Futile. They don't do anything but pay us lip service.

The DOE and EPA does NOT address the poisons we are clearly breathing nor the massive clean water that is poisoned by the mill. And for WHAT? The alleged smell of MONEY.

That money smell is for the lung doctors, the mill owners, the investors and not for Port Townsend. There are clean jobs that could come in and there is tons of clean up jobs. The PT Mill gets grants and lot's of hand outs, plus they use 14 Million Gallons of water a day. SURELY there can be a way to create 400 jobs in PT without poisoning us and ruining our quality of life.

Stephanie Ogle of the Washington  Department of Ecology gets her deep investigative results from the mill itself. 

And she says "Generally speaking, the operations at the mill were normal and the air pollution control equipment was operating within their normal ranges. They did not have any leaks/spills/abnormal releases during that period."

What does "generally" MEAN? This is our precious air. We have a right to clean air. The harassing smell that the PT mill puts out is toxic and annoying. There is no such thing as generally speaking. WE WANT FACTS, and the Clean Air and Water Laws OBEYED. The Washington Department of Ecology is SUPPOSED to make sure the laws are followed and not CODDLE corporations.



What does "normal" and "normal ranges" MEAN? 

Normal Ranges is the PROBLEM. The Mill's NORMAL toxic spewing is poisoning us, harassing us, and is in violation of the Clean Air Act. It is wrong, immoral and I believe flat out against the law to put these toxins in our air and water daily. The NORMAL RANGES need to be stopped as they are unconstitutional, unlawful and a complete violation of citizen rights and property rights.

Stephanie Ogle also says;

"While the emissions from the mill are within their normal operations, the weather can have an amplifying affect on the odors that are generated at the facility. It has been hotter and more humid recently and it looks like there are have been some periods of low to no winds, which can also increase the intensity of the odors. This may be why the odors have been worse during the past week.
I will continue to request that they investigate the odor complaints and I will let you know if they do find anything outside of their normal operating ranges."

ENOUGH with the blaming the Weather. JUST Stop the source of the toxins and DO YOUR JOB. Stop mumbling about weather, generally and normally and get STRICT about what is really going on. Protect the people paying your wage. The mill is SERIOUS bad every single day it is operating REGARDLESS of humidity, wind, weather or other mumbo jumbo.

STOP LETTING THE Bad Guys Regulate themselves. STOP calling the perpetrator and asking them if they are committing the alleged crime. INVESTIGATE yourself. Monitor the Air, Obey the Law.

"John Hughes | age 69, Chairman of the Board; Chief Executive Officer of AMCOL from 1985 until 2000. While Chief Executive Officer of AMCOL, Mr. Hughes developed a special understanding of the workings of AMCOL. He has used this experience to make contributions while on the Board.
Ryan McKendrick| age 60, President and Chief Executive Officer of the Company since January 2011. Prior thereto, Chief Operating Officer of AMCOL since January 2010, Senior Vice President of AMCOL and President of CETCO since 1998, and President of Volclay International Corporation since 2002. Mr. McKendrick has made contributions to the Board using his extensive knowledge of AMCOL developed during his service in various positions with the Company.
Arthur Brown| age 71, Retired Chairman and Chief Executive Officer of Hecla Mining Company, a producer of precious metals. Also a director of Idaho Independent Bank and Chairman of the Board of Silvermex Resources Ltd., an emerging silver producer. Mr. Brown has extensive mining experience, management and financial experience in various leadership positions as well as board experience, and has contributed his experience to the Board.
Daniel P. Casey | age 69, Private investor since 2002. Retired Chief Financial Officer and Vice Chairman of the Board of Gaylord Container Corporation, a manufacturer and distributor of brown paper and packaging products. Also retired Chairman of the Board of Caraustar Industries, Inc., a recycled packaging company. Mr. Casey has made contributions to the Board based on his board and financial management experience.
Frederick J. Palensky, Ph.D | age 62, Executive Vice President, Research and Development and Chief Technology Officer of 3M Company, a diversified technology company, since 2006. Prior thereto, Dr. Palensky served in a variety of management positions during his 35 year career at 3M. From 2004 through 2011, Dr. Palensky served as a director of Shigematsu Works Co. LTD, a manufacturer of particulate and chemical cartridge respirators in Japan. Dr. Palensky’s extensive management experience and technical expertise has enabled him to make contributions to the Board.
Jay D. Proops | age 70, Private investor since 1995. Prior thereto, Vice Chairman and co-founder of The Vigoro Corporation, a manufacturer and distributor of fertilizers and related products. Mr. Proops’ financial and public company experience has resulted in continued contributions to the Board.
Clarence O. Redman | age 69, Retired. Previously, of counsel to Locke Lord LLP from 1997 to 2007, the law firm that serves as corporate counsel to AMCOL. Secretary of AMCOL from 1982 to 2007. Mr. Redman’s experience as managing partner of a law firm, as well as his insight into AMCOL developed as outside counsel and Secretary, have led to contributions to the Board.
Dale E. Stahl | age 64, Executive Chairman of Port Townsend Holdings Company, Inc., a manufacturer of containerboard and corrugated packaging, since January 2011. Mr. Stahl served as President, Chief Executive Officer and Chief Operating Officer from 2000 through 2003 of Inland Paperboard and Packaging, Inc., a manufacturer of containerboard and corrugated boxes. Prior thereto, Mr. Stahl served as President and Chief Operating Officer of Gaylord Container Corporation. Mr. Stahl has executive and operational experience developed in leadership positions at various companies which he has used to contribute to his service on the Board.
Audrey L. Weaver | age 57, Private investor for at least the last 5 years. Ms. Weaver continues to use her knowledge of AMCOL and Board experience to contribute to the Board.
Paul C. Weaver | age 49, Private investor since 2006. Prior thereto, Vice President of Information Resources, Inc. from 2002 to 2006 and Managing Partner of Consumer Aptitudes, Inc. from 1997 to 2002 (both companies engage in marketing research). Mr. Weaver has extensive experience in marketing, as well as consumer and retailer research. He has made continued contributions to the operations of the Board.

Donald J. Gallagher | age 60, Mr. Gallagher, has served in a variety of management positions during his 31 year career at Cliffs Natural Resources Inc. and currently serves as Executive Vice President and President, Global Commercial. Mr. Gallagher served as Chief Financial Officer and Treasurer from 2003 through 2006. Cliffs Natural Resources is an international mining and natural resources company. Mr. Gallagher also serves on the Board of Directors of Fifth Third Bank’s NE Ohio affiliate.
William H. Schumann, III | age 61, Mr. Schumann, is scheduled to retire from FMC Technologies, Inc. on August 31 after serving in a variety of financial and management positions during his 31 year career at FMC Corporation and FMC Technologies. Mr. Schumann currently serves as an Executive Vice President and served as Chief Financial Officer from 2001 to 2011 at FMC Technologies. FMC Technologies is a leading global provider of technology solutions for the energy industry. Mr. Schumann also serves on the Board of Directors of Avnet, Inc., a distributor of electronic components, enterprise computer and storage products and embedded subsystems.
